MAGNUM FENCE † – TERMS & CONDITIONS

Magnum Fence is committed to providing quality workmanship and a professional installation experience. By approving this estimate, the customer agrees to the following terms:

#1. Utilities & Underground Conditions Magnum Fence will request utility marking prior to installation. However, private utilities such as sprinklers, irrigation lines, lighting systems, or unmarked underground structures are not included in locate services. Magnum Fence is not responsible for damage to unmarked or private utilities. If accidental damage occurs to sprinkler piping during installation, repair of the pipe will be completed at no additional cost. This does not include sprinkler heads, valves, or system relocation. ---

# 2. Site Preparation Customer is responsible for clearing at least two (2) feet on both sides of the fence line, including vegetation, trees, roots, pavers, concrete, or other obstructions. Failure to prepare the site may result in delays or a $250 return trip fee. ---

# 3. Soil Conditions & Obstacles Additional charges may apply for hard digging conditions including roots, rocks, or other underground obstructions. Specialized equipment, if required, will be billed separately. ---

# 4. Material Handling Excess soil will be spread along the fence line unless otherwise requested. Removal of excess materials is available at an additional cost. ---

# 5. Property Lines & Placement Fences are typically installed 4–6 inches inside the property line in accordance with local standards. Magnum Fence is not responsible for survey disputes or inspection failures resulting from customer-directed placement. ---

# 6. Surveys & Easements If property markers are not visible, a surveyor may be required at the customer’s expense. Installation within easements is at the customer’s risk and responsibility. ---

# 7. Ground Conditions & Gaps Fence installation follows natural ground contours. Minor gaps may occur due to uneven terrain and are considered acceptable within standard installation practices. ---

# 8. Permits & HOA Approval** Magnum Fence LLC will be responsible for obtaining all required fence permits from the appropriate city or county building department, including preparing and submitting permit applications, coordinating required inspections, and ensuring compliance with applicable local building codes and regulations. # 9. Scheduling & Weather Installation dates are estimates and may be adjusted due to weather, site conditions, or unforeseen circumstances. ---

# 10. Access & Safety Customer must provide safe and clear access to the work area. Delays due to restricted access may result in additional charges. Customer is responsible for securing pets during installation. Magnum Fence is not liable for animals escaping or related incidents. ---

# 11. Warranty Magnum Fence provides a 6-month workmanship warranty covering installation-related defects only. This warranty excludes damage caused by weather, ground movement, soil settling, misuse, or third-party modifications. ---

# 12. Cancellation Policy Deposits may be non-refundable once materials are ordered. Cancellations after project commencement may incur fees for labor and materials. ---

# 13. Payment Terms & Late Policy A deposit is required to secure scheduling. The remaining balance is due upon completion. A fourteen (14) day grace period applies. After this period, a late fee of $75 or 5% of the outstanding balance (whichever is greater) will apply, plus interest at 1.5% per month (18% annually), in accordance with Florida Statutes §687.03. Magnum Fence reserves the right to suspend work or withhold completion due to non-payment. A construction lien may be filed for unpaid balances pursuant to Florida Statutes Chapter 713. Customer is responsible for all collection costs, including attorney’s fees, as permitted by law.

# 14. Burrowing Owls (Cape Coral Protected Wildlife) Customer acknowledges that Cape Coral is home to protected Burrowing Owls and other wildlife species. If an active owl burrow or protected wildlife habitat is discovered on or near the proposed fence line, installation may be delayed, modified, relocated, or suspended as required by federal, state, county, or city regulations.

# 15. ADDITIONAL FEES & CHANGES Any additional costs resulting from homeowner-requested revisions, changes, re-inspections, or permit modifications will be added to the original invoice and shall be the homeowner's responsibility. Magnum Fence shall not be responsible for project delays, redesign requirements, permit restrictions, additional costs, or inability to complete the installation resulting from the presence of protected wildlife or protected burrows. Any additional permitting, environmental review, relocation, or compliance costs required by governmental authorities shall be the responsibility of the customer. ---
