MAGNUM FENCE – TERMS & CONDITIONS





At Magnum Fence, we are committed to delivering quality workmanship and a smooth, professional installation experience. Please review the following terms to ensure clarity and mutual understanding throughout your project:

What services do we offer?


1. Sprinklers, Pipes & Underground Wires

Magnum Fence will request utility marking prior to installation. However, private systems such as sprinklers, landscape lighting, or other buried lines are not included in this service. While we take every precaution to avoid damage, in the event that a sprinkler pipe is accidentally damaged during installation, Magnum Fence will repair the pipe at no additional cost. Please note that this does not include repair or replacement of sprinkler heads, valves, or the relocation of any irrigation components. Magnum Fence is not responsible for repairs or relocation of other private or marked utilities. If needed, we will assist in coordinating repairs with the appropriate provider.


2. Site Preparation (Brush, Trees, Obstacles)

To ensure an efficient installation, the customer is responsible for clearing a minimum of two (2) feet on both sides of the fence line. This includes removal of bushes, trees (including stumps), pavers, curbing, or concrete that may obstruct the installation. Failure to properly prepare the site may result in delays or a $250 return trip fee.


3. Hard Digging Conditions (Roots, Rocks, etc.)

If installation requires excessive digging due to roots, rocks, or other underground obstacles, additional charges may apply per hole. Specialized equipment, if required, will incur additional costs.


Excess dirt will be placed along the fence line, and larger rocks will be removed. If you prefer removal or relocation of excess material, this service is available at an additional cost of $100 per wheelbarrow load.

4. Dirt & Rock Handling


In compliance with local codes, fences are typically installed 4–6 inches inside your property line. If a customer requests installation outside of these guidelines, Magnum Fence is not responsible for failed inspections or any associated relocation costs.

We will make every effort to locate existing property markers. If markers cannot be found, a surveyor may be required at an additional cost (up to $100 per pin)

7. Easements


We install fences using a “straight method” that follows the natural contour of your land, creating a clean and professional appearance. While we minimize gaps as much as possible, minor gaps may occur due to uneven terrain and may require customer adjustments after installation.

8. Fence Alignment & Ground Gaps


Estimated installation dates are subject to change due to unforeseen conditions such as weather or job site challenges. We will always communicate any changes promptly and provide updated scheduling.

9. Installation Timeline


Any leftover materials remain the property of Magnum Fence and are included as part of the overall project cost.

10. Materials


The remaining balance is due upon completion of installation. Customer Acknowledgment I have read, understood, and agree to the terms outlined above. Magnum Fence has explained the process clearly, and I feel confident moving forward with my project.

11. Final Payment


A deposit is required to secure your installation date and cover material costs. Remaining balance is due upon completion of the installation. Late payments may be subject to additional fees. Magnum Fence reserves the right to delay or reschedule installation if payment terms are not met.

13. Permits & HOA Approval

It is the customer’s responsibility to obtain any required permits and/or HOA approvals prior to installation unless otherwise agreed in writing. Magnum Fence is not responsible for delays or additional costs due to missing approvals.



14. Weather Conditions

Installation schedules may be affected by weather conditions for safety and quality purposes. Magnum Fence will reschedule as needed and communicate any changes promptly.


Magnum Fence stands behind the quality of our work. We provide a workmanship warranty covering installation-related issues for a period of [6] months from the date of completion. This warranty does not cover damage caused by weather, ground movement, misuse, or modifications made by others.

16. Access to Property

Customer agrees to provide clear and safe access to the work area. This includes access for equipment, materials, and crew. Delays due to restricted access may result in additional charges.


17. Pets & Safety

Customer is responsible for securing pets during installation. Magnum Fence is not responsible for pets escaping or injuries occurring during the installation process.


Any cancellation after materials have been ordered may be subject to a cancellation fee. Deposits may be non-refundable depending on the stage of the project.

18. Cancellation Policy


Magnum Fence is not responsible for pre-existing property conditions, including but not limited to cracked concrete, unstable soil, or hidden structural issues that may affect installation.

19. Pre-Existing Conditions


#20 Payment Terms & Late Policy A deposit is required to secure scheduling. The remaining balance is due upon completion. A fourteen (14) day grace period applies. After this period, a late fee of $75 or 5% of the outstanding balance (whichever is greater) will apply, plus interest at 1.5% per month (18% annually), in accordance with Florida Statutes §687.03. Magnum Fence reserves the right to suspend work or withhold completion due to non-payment. A construction lien may be filed for unpaid balances pursuant to Florida Statutes Chapter 713. Customer is responsible for all collection costs, including attorney’s fees, as permitted by law.

# 21 . Burrowing Owls (Cape Coral Protected Wildlife) Customer acknowledges that Cape Coral is home to protected Burrowing Owls and other wildlife species. If an active owl burrow or protected wildlife habitat is discovered on or near the proposed fence line, installation may be delayed, modified, relocated, or suspended as required by federal, state, county, or city regulations. Magnum Fence shall not be responsible for project delays, redesign requirements, permit restrictions, additional costs, or inability to complete the installation resulting from the presence of protected wildlife or protected burrows. Any additional permitting, environmental review, relocation, or compliance costs required by governmental authorities shall be the responsibility of the customer. ---
